ARENA PLAN COMMISSION - unofficial minutes

The meeting was called to order.  Roll call was taken. Plan Commission members present are John Wright, Wayne Schutte, Cheryl Schmidt, Rod Anding. Others present are KayDee Maxwell, Dave Lucey, Terry Denruiter, Bill Gauger, Ingmar Nelson, David Sears, Sherri Sears, Ingmar Nelson

 

Anding motioned to approve the minutes from the Aug. 4, 2008 meeting. Schutte seconded, motion passed.

 

David Sears representing Kelly Sears - Requesting a building permit on Hwy K, 45 acres, zoned A1. There is a shop and a driveway on the property presently. They are using 1 acre of Ag land and four acres of rough land. Anding motioned to approve a building permit. Schutte seconded, motion passed. The $1000 fee was paid.

 

Jim Landre has a 20 acre wooded parcel off of Blue Ridge Road that was parceled off in 1990 or 1991. The zoning was left at A1, a nonconforming lot. In order for the County to let him build a shed on the property it has to be zoned AR-1. The Town wants to apply a deed restriction so that there will be no residential building site on the property.  Schutte moved to restrict the parcel to no home site. Anding seconded, motion passed.

 

Bill Gauger requests a conditional use permit to expand the pond on his property. The sand from the pond is stored on his commercial property. The final pond will be between 6 & 7 acres approximately 30 feet deep. Storm water permit is good till 2010 and pond permit from DNR is good till 2010. He needs his conditional use permit extended or dropped that allows him to store sand on his property. Asking for a one year permit to dig the pond. Schmidt motioned to extend his conditional use permit on sand storage till 2013 for the second pond. Schutte seconded, motion passed.

 

Discussion of putting a sunset clause on permits. Schutte feels that we have issued some permits and no further action is taken on the permit.  This may not be in the best interest of the Township. Schmidt suggested putting sunset clauses into our ordinances to make it legal. If the conditional use was not implemented within a year then the conditional use would be lost. Another option would be to put a sunset clause on the permit from the time it is obtained from the Town and the time it is approved by the County.

 

Anding motioned to adjourn. Schutte seconded, motion passed.
