ARENA PLAN COMMISSION

July 6, 2009

The meeting was called to order. 

 

Anding motioned to approve the minutes from June 1, 2009 meeting. Hottmann seconded, motion passed.

 

Roy & Kris Anding - Propose to rezone and create a 5 acre parcel on Demby Road. About 2.5 acres is woods and 2.5 acres is crop land. About 3 years ago the woods were taken out. Rod Anding has increased the tillable acres on the farm since he started running it (from 63 acres to 119 acres now). This plan doesn't chop up the land. Want to build a new house and leave the existing structure. The existing building could no longer be a residence.  They would have to alter the existing building. The Anding's will give the Town Board something in writing. They need to be out of the old house and in the new by April 1st, 2010. The land would be rezoned to AR1 residential and Kris could not run a business out of her house. The existing driveway is okay. Schutte motioned to approve a land division, a rezone to AR1, a building permit, the Anding's need a letter stating that the existing house will not be used as a residence, they will have 9 months to complete the new house and modify the existing house, the existing driveway is okay. Hottmann seconded, motion passed. Anding abstained from voting. The $1500 fee was paid.

 

Jeff and Connie McVay - Own 1,2, 3, & 4 and the east half of block 5. The owner of 6 is Judy White, 7 Jack & Irene White, 8 Gordy Patrow. They want to get rid of half of Lexington Street. Does the street have a value to the Township? Who would own it? McVay's would be increasing their lot size. McVay's have been there 8 years. Monroe Street is actually School Road. There is no Jefferson, Adam, Albany or Baltimore Street. If they are vacated then the land gets split down the middle to each land owner. An attorney would need to draft the documents. A private hearing would have to be published. They will have to come up with a legal description so the Town can vacate it. Hottmann motioned to approve them to start the procedures to vacate Lexington with borders of lot 1,2,3,4 on block 7 and half of lot 5 on block 6. Also vacate the alley between (Lots 1,2,7,8 in block 6). All adjoining land owners should be contacted.  Schutte seconded, motion passed. Connie is getting the Town a list of landowners with their addresses. She is also getting a legal description of the land.

 

Vern Halverson- did not have to get a conditional use permit for the grinding of the blacktop on the buffalo farm according to the County. He doesn't think the County charged them anything. Dave Lucey said the County did not want to do it because the conditional use had something to do with the mining also. He was just storing the product and then getting it out of there. The County said the Town could charge if we wanted to or not. Halverson is not selling the material, he is getting some of the material for the use of his land. Anding motioned to refund the conditional use fee. Murphy seconded, motion passed.

 

Rand Schott- 6690 Amacher Hollow Road. He wants to put a driveway from Amacher Road up to the meadow for now and then next summer finish the driveway and get a building permit. Murphy and Lucey shot elevations and all of them were okay except one. An adjoining land owner has a gate up across the road. Schott has an easement to use the road so he will talk with the landowner. The Town Board cannot approve a driveway permit without a building permit at the same time because they don't want a bunch of driveways going anywhere. Plus, the driveway standards might change before he builds his house. Schutte motioned to approve a driveway permit. The Town Board needs to know the location of the house. Murphy seconded, motion passed. The $500 fee was paid.

 

Rand Schott - conditional use permit for 6690 Amacher Hollow Road. 120 ft. tower  wind generator. There will not be any noise. He has a site assessment from Focus on Energy. This requires a conditional use permit because it exceeds the 75 ft. height requirement. The zoning is AR1. Murphy motioned to approve a conditional use permit for a wind generator. Schutte seconded, motion carried. The $250 fee was paid.

 

Fred & Julie Marti- 6002 Hwy HH. The County wouldn't process his zoning application because they thought it was flood plan. The County wants a 30 acre overlay that nothing can be built on, even a deer stand. Dave Lucey will go to the County tomorrow.

 

John Halverson- Hwy 14 - Baxter Road - the curb and gutter will only be moved 3 or 4 feet to the North. The DOT has tentatively approved a plan.

 

Erin Bowe & Robert Wolf - 5615 Blue Ridge Road - Wanting a building permit on 20.516 acres. A driveway permit is already approved, May 2006. A portion is a shared driveway. Anding motioned to approve a building permit for lot 1. Hottmann seconded, motion passed. The $1000 fee was paid.

 

Randy Pittman - Jerry White's parcel is zoned AR1 and they are going to add 8 feet to his parcel. The cheese factory parcel they want to zone it to AG Business because they want to have a retail store. They need to add 70 feet to their lot into the hill. Should the septic area be zoned Ag Business or not? The current zoning is A1. Schutte motioned to rezone the 2000 feet adjacent to Whites property to AR1, The Pittman property rezoned to Ag Business and rezone the area North of H (the septic site) to Ag Business if the County requires it.  About 2000 sq. ft. will be exchanged between Pittman's and Jerry White. Hottmann seconded, motion passed. Anding motioned to approve a conditional use permit for the retail store for cheese products and for the cheese factory. Murphy seconded, motion passed.

 

Bobby Rodemaker - 4 acres and they want to sub divide the house to make a duplex to rent out. This doesn't fit the Towns plan.

 

Public Comment - Rod Anding doesn't think we should be allowing anybody to do anything without knowing what they are doing. Driveway permits without building permits for example.

 

Schutte brought up the idea of using UW - Platteville students to map what is where in Helena?

 

Schutte motioned to adjourn, Hottman seconded, motion passed.
