Planning Committee Minutes

August 3, 2009

 

Present: David Lucey, Cheryl Schmidt, Wayne Schutte, Terry Denruiter, Bob Murphy, John Wright, Mark Hottmann.   Not present: Rod Anding and Bill Gauger.

 

Others Present:   Connie and Jeff McVay, Judy Peterson, Gordy Patrow, Peggy and Ruby Carpenter, John Halverson, and Igmar Nelson

 

Minutes from the July 6, 2009 meeting read from computer by Town Chair Lucey.  Corrections to be made:   Change "private hearing" to "public hearing" in the McVay matter; Rand Schott was driveway permit also; and on Pitman issue, instead of AG business, AB business zoning.   Discussion on Brent Duhr (we had agenda), he was not on last months agenda so not in minutes.   Schutte motion to approve minutes with corrections.  Murphy approved. 

 

Aug. 3 agenda-

 

1.  Brent Duhr, rezone and driveway permit for 5791 Hwy. K.  Oregon ran out of money for buyout on the selling/moving of four houses.  When he is able, when they are able to sell, he would put house in an area farther back from current house on his 2 acre parcel which was grandfathered in 1978 so now zoned A1.  Discussion on may want to do a rezone because if he ever wants to build a shed or garage or wants to sell, it would have to be zoned then.  County has said no rezoning has to be done.  Also discussed whether county is going to let him use current septic system.  He has to check on some of this.  This is tabled until Mr. Duhr finds out more on the Oregon house. 

 

2.   Gauger matter.  Decided to table this matter until Bill or Minnie are in attendance.  Schutte motion to approve tabling; Murphy seconded.

 

3.   Helena Matter/McVays, Connie and Jeff provided the information requested by the committee at last meeting, names, addresses and their okay with the vacating/splitting of streets.  McVays want to know their next step.  Lucey advised that our legals said not really a township matter, get interested parties together and make an agreement between them.  McVays advised they did that, an even split of the 66 foot right of ways to 33 feet to each party and 20 foot right of ways for alleys would be split to 10 feet to each party.  Suggested that they have an attorney get an agreement drawn up and request a public hearing.  Again we reminded them that the township has no legal input on individuals land ownership. We would need to publicize the public hearing two times, in local paper, need one public hearing.  The parties need an agreement and legal descriptions of all issues of division.  When get all that done, bring back to us.  Note that Monroe Street is actually School Street, Jefferson, Adams, Albany and Baltimore Streets are to be vacated.  Hottmann had already done a motion to vacate Lexington Street. 

 

4.   Discussion on the driveway permit along with a building permit.  The issue starting this discussion is the Schott matter, easement with three others.  Asked for an updated maintenance agreement.  Town Board said won't grant a building permit until there is an updated maintenance agreement.  The driveway has to be widened.  This particular issue has a maintenance agreement from 1994.  Discussion on changing our requirement for maintenance agreement to say bring up to code when additional driveways added.   Put this discussion on next agenda. 

 

Addendum to Helena issue/discussion.  Lucey did talk to the Dean at UW Platteville on having some students take the Helena platting matter on for credits.  They are writing a grant and will do that 1/4 of Arena first.  They will GPS it.  J. Halverson mentioned the difficulty in that area with surveying. 

 

Discussion on the Arena Village Truck Route and Hartung's selling of fertilizer plant to Anderson out of Ohio.
