ARENA PLAN COMMISSION

The meeting was called to order. 

 

Muphy motioned to approve the minutes from August 3, 2009 meeting. Anding seconded, motion passed.

 

Connie McVay - told that they needed an attorney to draft a letter including all parties that are affected in the vacating of the alley in Helena. They gave the letter to the Plan Commission. They only need to vacate half an alley on an dead end street. Anding motioned to accept Connie McVay's proposal contingent upon half of the alley on block 6 previously being vacated. Murphy seconded, motion passed.

 

Rand & CC Schott - don't have zoning for wind generator or horses when purchased the property. Got the zoning changed right away. The steepness of the driveway was an issue, but it could happen. David Moore owns the land that the easement is on. The difference between the two parties is what the easement agreement means. The Planning Commission has already approved a driveway permit for the Schott's. Rand would like a site visit meeting with the Planning Commission meeting. David Moore states that "Rights for a municipal permit are not listed within the easement. The easement does not allow for improvements, only maintenance." They can get permission from David Moore with seven conditions. One option Dave Moore suggests is to take the cases to a judge and interpret the easement. Dave is not opposed to a 12 foot driveway with pullouts conforming to Township standards. What is important to David Moore is that the next time somebody wants to change the road he wants the process changed. Wayne Schutte suggests suspending the driveway permit till the easement is agreed upon. The Plan Commission took a ten minute recess. Rand Schott requests that the driveway permit he has be suspended for 30 days until they can resolved some issues with the easement. When a driveway permit with an easement is applied for then the property owner needs to sign off on the permit from now on. Schutte motioned to suspend the driveway permit till the 5th of October. Murphy seconded, motion carried.

 

David Giffey - was told that his driveway was going to get a different name. The reason was for safety issues for satellite issues for emergencies. Giffey talked with the County and there are no statues requiring that. David Lucey thought the best thing to do was to rename the road if there were more residences on the road for safety reasons. David Lucey was wrong because Eric Drachenberg and Steve Wilkinson were against it.

 

Discussion on the building and driveway permit process. Do we have written standards that need to be met when a driveway permit is applied for when it is a multiple user driveway, asked Schutte? 

 

Anding motioned to adjourn. Schutte seconded, motion passed.
