Meeting was called to order.
Ingmar Nelson asked again if
it was okay to tape meetings. The Towns Association said it was legal to tape
the whole meeting unless it is disruptive or an individual absolutely ojects
then the board can go to closed session. It would be nice to inform everyone
that you are taping, but you don't have to.
Ingmar Nelson - should he
bring the Plan Commission up to speed? Ingmar had written a few letters to the
Town Board about possibly not having building permits on his land because Gary
Heck said that he had building permits from his property. Ingmar was sure that
they didn’t. Ingmar asked the Town Board to do research to make sure that he
has building permits. It says on Heck's title that he has 3 building permits.
Scott Godfrey said that they have had someone record a title to the White
House. Ingmar thinks that the Board said that they were not willing to assure
him he had his buiding permits. State Statue says that any rezoning, land
division says it's the Towns duty to record the number of building permits. The
deed is not relevant according to Scott Godgrey, said Terrry Denruiter. There
was 300 acres for Wittwer's property, Hartungs bought 100, Allsums bought 100
and Gary Heck bought less than 60 acres. According to the Towns attorney it is
our position to tell someone what there deed is and where they can build. It is
not our job to assign/re-assign building permits or interpret the law. The Town
was not involved in the sale so there is nothing in our minutes. Anding said
people that bought land after 1985 they are supposed to have the building sites
recorded at the time of purchase. Before 1985 then it is whatever was in
effect. Gary Heck didn't purchase the property till 1999. Heck didn't tell the
Board where the building permits came from. Ingmar has 239 acres, are we using
this for the basis of his building permits? Ingmar's deed doesn't say there are
extra building sites or anything. Ingmar wants to make sure the building sites
Gary Heck got don't affect Ingmar's property. Denruiter said nobody ever told
him that he doesn't have the building sites. Does he have proof. Ingmar has
legal paperwork showing that he has the building sites, but doesn't want to
show the board the paperwork.
Evy Halverson - Building
permit for a home. This was already acted on in the Dec. 7 minutes by the Plan
Commission. It will be discussed at the Town Board meeting.
How to handle zoning the
land? - Possible criteria for defining Ag land. Commercial land goes all the
way down Hwy 14, part of Hwy H, & Helena Road. Anything within 66 feet of a
roadway, flood pain, wetlands is out of it. We need a map of where the actual
flood plain is. Criteria: History of Ag.,
American Transmission
Company is going to put in power cable lines through our township into Spring
Green.
