ARENA PLAN COMMISSION

April 5, 2010

Meeting was called to order.

 

David Lucey motioned to move to closed session. Gauger seconded, motion passed.

Anding moved to amend the minutes from the April 1, 2010 meeting. Deleting the sentence "The committee has not said yes or no that Ingmar has building sites."

 

Wayne motioned to approve the minutes from the March 1, 2010 meeting. Anding seconded, motion passed.

 

Connie Perry - representative for her mother's estate. 108 acres on Hwy K, house and barn on the site. Has a list of questions. How many building sites, 2 more (1 per 30). Can have more parcels, but won't have a building site. All property A1. 40 acres is the smallest farm. Driveway has to follow an existing tree line or fence line. Her brother has 12 acres from the farm that was split off in 1983 so he should have a parcel of record for a dwelling. A 10 acre parcel for hunting only is okay, with a deed restriction. Make sure that deeds say if there are or are not building sites. Minimum of 5 acres per home site, no maximum. If a parcel is less than 40 acres you would have to rezone and pay the conversion fee. If split into 40 acres then you should designate building sites. A hunting cabin counts as a building site. Once they have a plan she can bring it to the Plan Commission and County.

 

Dereck Yapp - 7141 Hwy H, building site. Home will be 1500 sq. ft. Anding motioned to approve a building permit. Hottmann seconded, motion passed.

 

Sam Mahara - own property in Illinois and Wisconsin. Wife wants to be in IL, he is in WI. His house is basically setup as a duplex with 4 exit doors and two living rooms, bathrooms, bedrooms. Wants to rent excess space in his home. There are 1500 sq. ft. of living space. Zoned for single family dwelling. He is willing to give up a conditional use, vehicle storage and sales, to rent the extra space. County said if Arena don't care they don't care. We have already denied a request to someone else for a duplex. Sam's plan is to be living in IL and WI 50/50 of the time. Sam just won't charge rent. If the house has two families living in it at anytime then it doesn't meet the Town's plan. The Town cannot issue a multi-dwelling permit.

 

Andy Olson representing John & Kathleen Dinovella - bought 10 acres from Vern Halverson along Hwy 14. They will need a driveway permit. House is 2232 sq. ft. Schutte motioned to approve a building and driveway permit contingent on getting the paperwork in.  Hottmann seconded, motion passed.

 

Bill Gauger - 27.93 acres currently zoned AR1, wants RB. Horse trails that people pay to ride on. Lot 3 change zoning to RB. Lot 1 where horse trail will be, will give lot 3 a 100 foot easement to go around the outside, currently zoned AR1. The easement will be zoned RB. Could you build a house on it means it is RB? The Town would ask him to give it up if so. Horse stable is already there. Building permit from County last year. Only his horses are there, application was for 35 horses. Field where people can park. About an hour horse ride of trail. Horses in stable are owned or leased by Gauger's. Will have porta-potties. Wright motioned to approve conditional use for horse trails and a riding stable business, stable is for 35 horses owned or leased by Bill Gauger, the trail will follow a 100 ft. easement on lot 1 boundary lines, access will be gained by an easement on lot 3, there will be no residential building site available for lot 3, ( the owner has relinquished the building site so it will not be built on) rezone 27.93 acres from AR1 to RB1, will follow Township standards for signage. This is the only conditional use on the lot, any pre-existing conditional uses are void. This a definition of a small family owned agriculture business? Will be doing business 7 days a week. Will get a letter for his son as an adjoining land owner. Hottmann seconded, motion passed.

 

Ingmar Nelson - doesn't have anything new. Wright asked him to fill out an application for next month.

Schutte moved to approve the minutes from the special meeting on March 15, 2010. Anding seconded, motion passed.

 

Hottmann motioned to adjourn. Schmidt seconded, motion passed.
